The DC Circuit Court has upheld the Protecting American From Foreign Adversary Controlled Applications Act, rejecting TikTok's attempt to overturn the legislation. This law was passed with strong bipartisan support and aims to address national security concerns related to TikTok's ownership by ByteDance.
Chairman Moolenaar commented on the court's decision, stating, “Today’s ruling is a victory for the American people and TikTok users, and a loss for the Chinese Communist Party, which will no longer be able to exploit ByteDance’s control over TikTok to undermine our sovereignty, surveil our citizens, and threaten our national security." He expressed optimism that President Trump would facilitate an American takeover of TikTok.
Ranking Member Krishnamoorthi also weighed in on the ruling: “With today’s opinion, all three branches of government have reached the same conclusion: ByteDance is controlled by the Chinese Communist Party, and TikTok’s ownership by ByteDance is a national security threat that cannot be mitigated through any other means than divestiture." He emphasized that every day TikTok remains under its current ownership poses a risk to U.S. security.
This decision marks a significant step in addressing concerns about foreign influence over popular digital platforms used within the United States.
