On June 30, 2023, the Supreme Court struck down President Joe Biden's plan to transfer college debt from the individuals who took out loans and put it on the American people, including those who never attended college. Biden’s plan was imposed by executive order and was never passed by Congress.

“This ruling is a win for the Constitution and the rule of law. The Constitution is very clear that no federal funding can be used unless Congress passes a law allowing it to happen. The Supreme Court has rightfully stopped President Biden from spending billions of dollars with no legal authority to do so. College administrators must do more to bring down the cost of college and provide value to the students who enroll in their schools,” said Congressman John Moolenaar.

Article I, Section IX of the U.S. Constitution says:

"No Money shall be drawn from the Treasury, but in Consequence of Appropriations made by Law; and a regular Statement and Account of the Receipts and Expenditures of all public Money shall be published from time to time."
